Amendment C217brim - Anomalies

Amendment C217brim proposes to correct a range of current anomalies (administrative errors and redundant provisions) in the Brimbank Planning Scheme. While Amendment C217brim doesn’t change or introduce new policy, Council is required to notify affected land owners and occupiers.

Key changes

  • Rezoning land where it is inappropriately zoned or where land parcels are included in more than one zone.
  • A correction to the schedule to Clause 43.01 (Heritage Overlay)
  • Corrections to the table at Clause 1.0 of the schedule to Clause 52.28 (Gaming) to address land description errors and omissions.

Exhibition period and submissions

Amendment C217brim was exhibited from 31 March 2022 until 4 May 2022, in accordance with Section 19 of the Planning and Environment Act 1987 (the Act).

Council received four submissions about the Amendment. Council considered all submissions at its’ meeting of 19 July 2022.  In accordance with Section 21(2) of the Planning and Environment Act 1987, these submissions will be available to be inspected at its office until the end of two months after the amendment comes into operation or lapses.

At its meeting of 19 July 2022 Council resolved to adopt the amendment with changes and submit the Amendment C217brim to the Minister for Planning for approval. You can read the Council Report and associated amendment documents below:

Amendment C217brim was submitted to the Minister on 21 July 2022. The amendment will come into effect when a notice is published in the Government Gazette. Council will notify submitters and affected land owners when this occurs.
